1.⁠ ⁠Scope

These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts for the purchase and delivery of Green Bull®️ brand products concluded by Alganize GmbH, Flughafen Tegel, 13405 Berlin (hereinafter referred to as “we” or ‘Alganize’) as the distributor with consumers (§ 13 BGB, hereinafter referred to as “customer”).

2.⁠ ⁠Conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

By clicking on the “Buy now” button, the customer submits a binding offer.

The contract is concluded when we confirm the order by email or ship the goods.

 

3.⁠ ⁠Prices and terms of payment

All prices are final prices in euros and include statutory value added tax.

We may charge additional shipping costs, which will be displayed during the ordering process.

Payment is made in advance, by credit card, PayPal, or other offered payment methods.

 

4.⁠ ⁠Delivery and transfer of risk

Delivery is made within Germany, unless otherwise stated.

The risk of accidental loss is only transferred to the customer upon delivery of the goods.

 

5.⁠ ⁠Right of withdrawal for consumers

Consumers have a statutory right of withdrawal in accordance with § 355 BGB (German Civil Code).

 

Exception pursuant to Section 312g (2) No. 3 BGB: The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

 

Cancellation policy:

You have the right to cancel this contract within fourteen (14) days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

 

To exercise your right of withdrawal, you must inform us (Alganize GmbH, Flughafen Tegel, 13405 Berlin, email: greenbull@alganize.de) of your decision by means of a clear statement (e.g., by letter or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

 

In the event of withdrawal, we will refund all payments, including delivery costs, immediately and at the latest within fourteen days from the day on which we receive notification of your withdrawal. The refund will be made using the same means of payment that you used for the original transaction, unless expressly agreed otherwise.

 

You must return the goods to us immediately and in any case no later than fourteen days from the date on which you notified us of your withdrawal. The deadline is met if you send the goods before the deadline expires.

 

You shall bear the direct costs of returning the goods.

 

Exclusion of the right of withdrawal:

The right of withdrawal does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (Section 312g (2) No. 3 BGB).

6.⁠ ⁠Retention of title

The goods remain our property until full payment has been received.

 

7.⁠ ⁠Warranty

The statutory warranty period of 24 months applies.

The customer is obliged to report obvious defects within 14 days of receiving the goods.

 

8.⁠ ⁠Liability

We are liable without limitation in cases of intent and gross negligence, for personal injury, and under the Product Liability Act.

In the event of a slightly negligent breach of duty, we shall only be liable for foreseeable, contract-typical damages.

 

9.⁠ ⁠Place of jurisdiction and applicable law

For contracts with consumers, the law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Mandatory consumer protection regulations of the country in which the customer has their habitual residence remain unaffected.

The place of jurisdiction is the consumer's place of residence.

 

10.⁠ ⁠Final provisions

Should individual provisions be invalid, the remaining provisions remain unaffected.

The contract language is German.
